Viet Nam bans import of goods produced by forced labor

VGP – Viet Nam strictly prohibits the importation of products and goods mined, produced, or manufactured wholly or in part by forced labor from enterprises, countries, or territories.

The Government has promulgated Decree No. 292/2026/ND-CP dated July 22, 2026 on detailed implementation of several articles of the Law on foreign trade management.

Specifically, Article 5 of Decree No. 292/2026/ND-CP on goods prohibited from export and import provides as follows:

1. Goods prohibited from export and import shall comply with the provisions of prevailing legal documents and the List of Goods prohibited from export and import prescribed in Appendix I promulgated together with this Decree.

2. Based on Appendix I of this Decree and prevailing legal documents, Ministers and Heads of ministerial-level agencies shall be responsible for promulgating detailed lists of goods prohibited from export and import together with their Harmonized System (HS) codes, except where prevailing laws have already provided detailed regulations on the HS codes for such goods.

Goods prohibited from export and import under the provisions of Appendix I of this Decree are goods with HS codes and detailed goods descriptions belonging to the detailed Lists published by Ministers and Heads of ministerial-level agencies.

3. The approval for the export and import of goods prohibited from export and import under Clause 2, Article 10 of the Law on Foreign Trade Management and Clause 1, Article 28 of the Government's Decree No. 146/2025/ND-CP on decentralization and delegation of authority in the industrial and commercial sectors shall be executed in accordance with Clauses 4 and 5 of this Article.

Where necessary, Ministers and Heads of ministerial-level agencies shall promulgate legislative documents detailing the licensing of exported and imported goods prescribed in this Clause.

4. An application dossier for permission to export or import goods prohibited from export and import under Clause 3 of this Article shall include:

a) An application form for the export or import of goods prohibited from export and import made according to Form No. 01 in Appendix VII attached to this Decree or according to the form prescribed by the Minister or Head of the competent managing ministerial-level agency (if any): 01 original copy.

b) An explanatory document on the plan for use, management process of exported or imported goods during use, and plan for disposal of exported or imported goods after use: 01 original copy.

c) A report on the implementation status of previously issued licenses (if any): 01 original copy.

d) Other documents and papers prescribed by the Minister or Head of the competent managing ministerial-level agency (if any).

5. Licensing procedure for the export and import of goods prohibited from export and import under Clause 3 of this Article:

a) Traders shall submit an application dossier for the export or import license for goods prohibited from export and import under Clause 4 of this Article to the licensing authority.

b) In case the dossier is incomplete or non-compliant with regulations, within 03 working days from the date of receipt of the dossier, the licensing authority shall notify the trader to supplement and complete the dossier.

c) Within 05 working days from the date of receipt of a complete and valid dossier, the licensing authority shall issue the License to the trader for the export or import of goods. In case of refusal to issue the License, the licensing authority shall respond in writing, clearly stating the reasons therefor.

d) The licensing authority shall specify the validity period of the written approval permitting the trader to export or import goods on a case-by-case basis.

6. The duration for retaining and using imported prohibited goods in Viet Nam under Clause 3 of this Article shall be implemented as registered by the trader with the licensing authority, but shall not exceed 02 years.

7. Traders granted export or import licenses under Clause 3 of this Article shall be responsible for submitting a report according to Form BC01 in Appendix VII attached to this Decree to the licensing authority no later than December 31 annually regarding the export, import, and utilization of the goods, as well as the disposal of the goods after use.

List of goods prohibited from export and import

Appendix I promulgated together with Decree No. 292/2026/ND-CP specifically regulates the List of goods prohibited from export and import.

In particular, the List of goods prohibited from export includes items such as: Weapons, ammunition, explosives; round timber and sawn timber of all kinds from domestic natural forests; rough diamonds prohibited from export under the Kimberley Process Certification Scheme; electronic cigarettes, heated tobacco products.

The List of goods prohibited from import includes: Weapons, ammunition, explosives; fireworks and pyrotechnics of all kinds (excluding maritime safety signal flares used in accordance with the guidance of the Ministry of Construction), sky lanterns, and speed camera jamming devices; electronic cigarettes, heated tobacco products; used consumer goods; used vehicles (including the following categories: a) Textiles, garments, footwear, and apparel; b) Electronic goods, refrigeration equipment, and household electrical appliances; c) Interior decorations; d) Household utensils made of ceramics, porcelain, glass, metal, plastic, synthetic materials, and other materials; dd) Bicycles, motorcycles, and mopeds); used medical devices; goods that are used digital technology products.

Notably, the Decree strictly prohibits the importation of products and goods mined, produced, or manufactured wholly or in part by forced labor from enterprises, countries, or territories in accordance with relevant international treaties to which the Socialist Republic of Viet Nam is a contracting party.
